remote bricking without user authorization is explicitly illegal as it renders the device that the user paid for unusable, depleting its value; it'd be functionally the same as if they came in and smashed it. nintendo tries to get around this by claiming that the user agreed to it in the tos; in order for that to even potentially hold weight, the provision itself needs to be clear and obvious and the user's consent must also be clear, obvious, and informed. courts haven't even consistently found that shrinkwrap mandatory terms of service for devices like this are in and of themselves enforceable due to informed consent issues, let alone an exceptionally dubious provision like this. courts could even potentially strike it just because it's such a one-sided term and there's no recourse for the buyer to reclaim their device's value. it's likely that if they did remote brick a device, they would at least be required to repair or replace it under warranty or offer a refund. failing that, they could be sued for damages.
in practical terms, if nintendo actually remote bricked your device (not just banned it from their services) and you actually wanted to go down a legal route, your best options would be small claims (where procedures tend to be vastly simplified, you don't even generally need a lawyer for this) or, if this happened to a lot of people, joining a class action suit. if you bought the device in your state and agreed to the contract in your state, in most cases you can file the small claims case in your local jurisdiction even if nintendo's american offices are based out of some other state.

It is illegal, there are consumer protection laws specific to this bullshit. Same goes for the "legal arbitration" BS they slipped into their new ToS.
