Mare basically permits stealing cosmetics. FFXIV is very friendly with it's pricing structure compared to some games -- monetizing appearance rather than power. I'm not surprised Mare has legal problems.
BTW, likely the reason dalamud is safe is due to an ADA lawsuit I heard about; the gist was player got banned for using UI automation mods (basically what most of dalamud's mods do). Guy was handicapped and sued under the ADA accessibility laws.
I don't have details, can't confirm it reached judgement or was settled or was real or urban-legend, but it's believable. Around the same time I heard about this, other MMOs I was playing also backed off on UI mods. Seems to be "if you're at the keyboard, it's all OK" these days.
