This isn't actually new to how Nintendo works. The 3DS and Wii U could also be remotely disabled and required you to create a new NAND ticket with a fresh install of the system's BIOS. I had the same issue when I was messing around with my 3DS and accidentally went to the eShop with a hacked 3DS + pirated software. It was easier with the 3DS to gain a new NAND manually and completely revert the system back to full functionality, but without Switch 2 hacking tools, that's gonna remain a pipe dream for a while longer.

However, the console ban still sticks even with a factory reset. Meaning it must be on a firmware-level, probably poisoning the NAND ticket (excuse me if I am using the wrong term, hacker/v/ros). This is what they mean by being unable to revert the change, Nintendo likely messed with the raw BIOS for the Error Code to work and they can't revert it without giving you access to such.

The problem here comes from context and wording. Sony lost this one as it was seen as excessive use of force on an issue they themselves made unclear. There was nothing in the TOS about sharing the PS+ Collection, hence why there was a leg to stand on. Brazil is going against Nintendo's own TOS wording this time. Literally nothing of value is lost here. If you're a console gamer, why would you ever want to rely on services and eShop games instead of buying physical copies of games and just playing multiplayer over LAN or split-screen? I thought the whole point of consoles was actually owning your games.
Remember that if the current trend continues, at least 85% of all physical games released for the Switch 2 will actually be digital and will require the entire game to be downloaded from the Internet. So if Nintendo decides to punish you for daring to make unauthorized use of your own hardware, your Switch will lose access not only to updates, patches, online play, and downloads, but also to thousands of "physical" games.
The Switch 2 is the final nail in the coffin for the poor souls who had any illusions that they would ever own anything.

But they don't want to front the cost of cartridge production, especially if there wouldn't be smaller cart sizes than 64 GB for another year or so (and before you, the concept of a smaller SDXC Express cart is actually pretty stupid. Imagine wanting a trading card game be made on bible-thin paper instead of card tsock in terms of production cycles. It would make no sense to make unless Bible Battles became a massive hit). The ability to sell back these digital games is supposed to be the win on the consumer end.

I do think this issue will start to rectify itself by Year 2 of the S2's lifespan, once more SDXCEX cards in smaller sizes start being made and the message becomes clear that the physical game purists make up more than a minority.
