If it DOES have merit, it would be the irresponsibility of this factor. Nintendo themselves have stated with customer support lines that they CANNOT revert the error themselves. This error works on a CONSOLE-level, not an ACCOUNT-level, as people have tested that the same violating account can just log on a different Switch 2 with no result. And even full factory resets doesn't fix the issue. It is likely they are telling the truth and probably should be held accountable. Imagine someone going "I reserve the right to shoot you if you step on my lawn" but they can't tell the difference between a glock and a cannon. But even then, it would be an uphill battle to prove in a court of law that they shouldn't be allowed to kill you until then understand.
This isn't actually new to how Nintendo works. The 3DS and Wii U could also be remotely disabled and required you to create a new NAND ticket with a fresh install of the system's BIOS. I had the same issue when I was messing around with my 3DS and accidentally went to the eShop with a hacked 3DS + pirated software. It was easier with the 3DS to gain a new NAND manually and completely revert the system back to full functionality, but without Switch 2 hacking tools, that's gonna remain a pipe dream for a while longer.

Switch bans are tied to the serial of the console. They are reversible, but it's not likely that Nintendo will unban a console if you ask them to unban it for you. It requires a similar level of documentation to the level necessary to get an eShop refund, and even then, the chances are low that you'll actually get an unban pushed through. They do not permanently disable all functionality of your console, they just suspend your access to offline services. You won't be able to add friends, access the eShop or play most games online, but some games use their own online services, like Fortnite, and you can play those. This is all stuff that carried over from the Switch 1.
The headline that the one guy got banned for having his Switch username set as "Twink Link" is 100% fake. I've seen public accounts of Switch users in the past being named Nigger or Faggot and usually what happens is that you get reported by another user and Nintendo blanks your name out. Nintendo constantly updates its banned word list for case like this, so they have no need to permanently ban your console for usernames.

Remember that recently Elon Musk refused to abide a Brazilian court ruling that determined him to disable someone's Twitter account. The judge applied a 5 million fine. Elon Musk reacted by pulling all of Twitter's structure and workers from Brazil. So what did the judge do? He got the money from Starlink instead, which made Elon have a meltdown.

ESL or not, I think this is also fair to bring up. But Nintendo was put in a rock and a hard place with this stupid deal. They know that the Switch 2 is going to be more reliant on 3rd-party sales to justify the higher power and pricetag for it (despite the launch suite being really insane for Ninty standards when you think about it, 4K 120 FPS Metroid Prime sounds like a fake /v/ post). But they don't want to front the cost of cartridge production, especially if there wouldn't be smaller cart sizes than 64 GB for another year or so (and before you, the concept of a smaller SDXC Express cart is actually pretty stupid. Imagine wanting a trading card game be made on bible-thin paper instead of card tsock in terms of production cycles. It would make no sense to make unless Bible Battles became a massive hit). So the Game-Key Card came out with this dealing. In Ninty's mind, it is a Win-Win for all, except physical game purists who's been a minority since the start of 8th Gen. The ability to sell back these digital games is supposed to be the win on the consumer end.

But yeah, these things are just...terrible. A waste of plastic, they aren't physical games, they aren't cheaper, and physical game purists are not those that sell back their games. I do think this issue will start to rectify itself by Year 2 of the S2's lifespan, once more SDXCEX cards in smaller sizes start being made and the message becomes clear that the physical game purists make up more than a minority. At most, a game-wide ban. They have the tools for both, and they decide which one they want to use. And usually, they gonna side on just the time-out zone because they still kinda-sorta value you as a consumer of their products.

It is entirely possible to get console banned, but you have to do something incredibly stupid and harmful to get to that point. That's the biggest consumer risk I find, but that applies to any form of ban, account or console. And like I said, that's just precedent that ain't going away, not while Steam remains the biggest PC storefront with a highly volatile, explicit permission to destroy your account as they see fit. Google is also similar, we just let them delete entire accounts for actions on one service, such as YouTubers that get copyright terminated losing their e-mails.

I don't like the modern ideal of "You don't own anything" as much as the next neckbeard. But in this wicked system of things, that's the deal you work under. You do lose access to your licenses if you violate the TOS. And even then, that's not "bricking" your system, not under any legally defendable case. Remember, "reasonable doubt" is your enemy here.

The MiG Switch issue is different from being console banned by online behavior. There's a big difference between dropping the n-bomb in a public lobby and just using pirate hacking hardware, even in an earnest, good faith attempt (for the love of god, just keep the damn thing offline until you are done!!). I can see this story breaking out into a big issue should this happen. But outside of the feasibility of such an event happening, Nintendo still have the legal highground in this event. There is a reason the "Licensed By Nintendo" sticker is still a thing, it gives them liability-by-surrogate-actors protections. It's sort of like how you can't sue a company for buying an open jar of food, you should reasonably know that the anti-tamper seal was broken.
I do agree that they should have a way to just unban the consoles. The methods they and every other company have is kinda stupid and arguably anti-consumer.
