"free will" in the fucking metaphysical sense may or may not exist, but when a guy is tortured, he'll give up information he wouldn't otherwise give up. would you call that free will? no.
therefore, he shouldn't receive the same punishment as if he had handed over the information freely, without any torture or force involved.
