Most states where incest is illegal—and I can't imagine it would be different in most Euro countries—will not actively pursue a case in the specific example of consensual sex between adult siblings. Incest is almost always tacked on as a charge to more serious crimes like rape, molestation, or domestic abuse, and even then I say "almost always" because I haven't looked at literally every case to ever involve incest in the history of the Unitides States and am assuming there's at least one case of that being the primary or sole charge. The amount of effort it would take versus the payoff would be fucking insane in that specific case because they'd have to prove beyond a shadow of a doubt that two people were fucking when there are no witnesses, DNA evidence—presumably—cannot be acquired due to a lack of consent from either party, and neither party will confess. That should would get thrown out as soon as it slid onto a judge's desk, and that's if the police even bothered to pursue it in the first place since they almost always have more important shit to be dealing with.
